Did you know this?
If you are an employer and you set the work start date too early for the Skilled worker candidate on your Certificate of Sponsorship (CoS), this will not account for the visa processing time by the Home office. You must also take into account delays from the Home office regardless of the processing times quoted by them. Numerous issues such as staff shortages, IT failures and other Visa work taking priority can have a huge impact on how Skilled worker visas are assessed by a Home office decision maker.
If this happens, time is already ticking on your Certificate of Sponsorship even before you get your Skilled worker visa.
Even if you get your visa at a later date, the work end date on the CoS will not automatically change, therefore reducing your visa period.
This is precious time (and money) that can count towards Indefinite Leave to Remain / Permanent Residency.
Here is what you can do:
Set a CoS start date for a future date (at least 4-8 weeks)
Why is that?
The Immigration rules state that you can start working for your sponsor as soon as you get your Skilled worker visa, even if the work start date is at a later point.
Many employers do not know this and they can now use this knowledge as a strategic advantage for their business.
